Welcome
These Terms of Service ("Terms") govern your use of the Period Health Clinic website ("the Site"), operated by Period Health Clinic LLC, a Colorado limited liability company ("Period Health Clinic," "we," "us"). By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site. We've written these Terms to be readable, because terms you can't understand protect no one.
If this is an emergency, stop reading and call 911. This website and our telehealth visits are never appropriate for emergencies — including severe or sudden pelvic pain, heavy bleeding with dizziness or fainting, chest pain, difficulty breathing, or thoughts of harming yourself. For a mental health crisis, call or text 988. No message sent through this Site or our portal is monitored for emergencies.
1. This website is not medical care
The Site provides information about our practice and educational content about menstrual and reproductive health. Reading it, filling out a contact form, or emailing us does not make you our patient and does not create a physician–patient relationship. That relationship is created only when you register through our secure patient portal, complete intake, sign the required consents (including telehealth informed consent), and are accepted as a patient for a scheduled visit. Until then, nothing on this Site is medical advice for your specific situation, and you should not act or delay seeking care based on something you read here.
Educational content on the Site reflects our understanding of current clinical evidence at the time it was written. Medicine changes; individual situations differ. Always talk to a clinician who knows your history before making health decisions.
2. Who may use the Site and our services
You must be at least 18 to use this Site on your own behalf and to book care. Care for patients under 18 is arranged by a parent or legal guardian through the patient portal, with the consent and assent process described during registration.
Our clinical services are available only to patients who are physically located in Colorado at the time of their visit. We verify location at every appointment because physician licensing is state-based. If you are outside Colorado at visit time, we will need to reschedule.
You agree to provide accurate, current information when you contact us or register, and to keep your portal login credentials private. You are responsible for activity under your account.
3. Clinical services, and the documents that actually govern them
Telehealth visits, follow-ups, messaging with your clinician, lab ordering, and prescriptions are clinical services delivered through our patient portal — not through this Site. Those services are governed by the agreements you sign at registration: our telehealth informed consent, Notice of Privacy Practices, financial policy, and (for minors) parental consent documents. If these Terms ever conflict with those clinical documents regarding your care, the clinical documents control.
We describe our visit types and time-based pricing on the Site so you always know the cost before booking. Prices shown are current as of their posting date and may change; the price shown at the time you book — and the written Good Faith Estimate you receive — is the price that applies to that visit.
4. Booking, payment, cancellations, and refunds
Payment
Visits are paid by credit, debit, HSA, or FSA card through our portal. We do not currently bill insurance directly; you receive a superbill you may submit to your insurer, and reimbursement is between you and your plan — we can't guarantee it.
Good Faith Estimate
As a self-pay practice, we provide a written estimate of costs when you schedule, as required by the No Surprises Act.
Cancellations
Plans change — we get it. Cancel or reschedule at least 24 hours before your visit at no charge. Late cancellations and no-shows are charged a reasonable fee, because that time was held for you and could have gone to another patient. If we ever need to cancel on you, you'll be rescheduled promptly or fully refunded, your choice.
Technology failures
If a visit can't be completed because of a technical problem on our end, we'll finish by phone where clinically appropriate, or reschedule or refund the visit — you will not pay for care you didn't receive.
Refunds
Completed visits are generally non-refundable, since the service is the clinician's time and expertise. If something went wrong, contact us — we'd rather fix it than argue about it.
Messaging
Brief questions about your active care plan are included in your care. Message conversations requiring new medical decision-making may be billed as a portal message consult at the posted price — and we will always tell you before anything becomes billable.
5. Communications
If you give us your email or phone number, you agree we may contact you about your inquiries, appointments, and account — these are transactional messages. Marketing emails are sent only if you opt in, and every one includes a working unsubscribe link. Message and data rates may apply to texts; reply STOP to opt out of texts at any time. Email and text are not secure channels and not monitored continuously — never use them for urgent symptoms, and use the patient portal for anything involving your health information.
6. Acceptable use
You agree not to: use the Site for any unlawful purpose; attempt to access accounts or systems that aren't yours; scrape, harvest, or bulk-download Site content or data; upload malicious code; impersonate any person; misrepresent your location to obtain care in a state where we don't practice; or use the Site to harass our staff or other patients. We may suspend Site access for violations. (Ending a patient relationship, if ever necessary, follows the clinical and ethical rules that govern medical practices — not this paragraph.)
7. Intellectual property
The Site and its content — text, graphics, logos, the Period Health Clinic name and marks, and our educational materials — are owned by Period Health Clinic LLC or licensed to us, and are protected by copyright and trademark law. You may view, download, and print Site content for your personal, non-commercial use, keeping all notices intact. Anything else — republishing, commercial use, training automated systems on our content — requires our written permission. If you send us feedback or suggestions, you grant us the right to use them without obligation, though we'll be grateful.
8. Third-party services and our affiliated company
The Site links to third-party services we use — such as our patient portal, scheduling, and payment processor — and may link to outside educational resources. Those services have their own terms and privacy practices, which govern your use of them; we're not responsible for third-party sites we don't control.
Transparency about Wave Bye: Period Health Clinic's founder also founded Wave Bye Inc. (wavebye.co), a separate company developing menstrual-pain products, including dietary supplements available today. The two companies are affiliated but distinct, and your clinician's medical recommendations are governed by clinical evidence and your individual situation — never by Wave Bye's commercial interests. If a Wave Bye product is ever discussed in your care, the relationship will be disclosed, alternatives will be offered, and buying anything is never a condition of care. Supplement statements have not been evaluated by the FDA, and supplements are not intended to diagnose, treat, cure, or prevent any disease.
9. No guarantees; disclaimers
We work hard to keep the Site accurate, available, and useful, but we provide it "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site — express or implied, including merchantability, fitness for a particular purpose, and non-infringement — and we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Health outcomes can never be guaranteed by anyone honest, and we don't guarantee them; what we promise is careful, evidence-based, unhurried medicine.
10. Limitation of liability
To the fullest extent permitted by law, Period Health Clinic LLC and its owner, clinicians, and staff will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site (as distinct from clinical care), and our total liability for Site-related claims is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.
Important carve-out: nothing in these Terms limits or waives any right you have with respect to the professional medical care we provide, limits liability that cannot be limited under law, or waives protections you hold as a patient under Colorado or federal law. Clinical care is governed by the clinical relationship and applicable medical-professional standards, not by this Site document.
11. Indemnification
You agree to indemnify Period Health Clinic LLC against claims and costs (including reasonable attorneys' fees) arising from your violation of these Terms or your unlawful use of the Site. This section does not apply to your good-faith use of the Site or to anything related to the medical care you receive.
12. Governing law and disputes
These Terms are governed by Colorado law, without regard to conflict-of-law rules. Disputes about the Site will be resolved in the state or federal courts located in Colorado, and you and we each consent to their jurisdiction. Before filing anything, contact us — most problems are misunderstandings, and we resolve them quickly. Claims relating to medical care follow the legal rules that govern such claims, not this paragraph.
13. Changes, severability, and the whole agreement
We may update these Terms as the practice evolves; the "last updated" date above will change, and meaningful changes will be noted on this page. Continued use of the Site after changes means you accept them. If any provision is found unenforceable, the rest remain in effect. These Terms plus the Privacy Policy are the entire agreement about the Site; your clinical documents are the entire agreement about your care.
14. Accessibility
We want this Site usable by everyone. If you encounter an accessibility barrier, tell us at info@periodhealth.clinic and we will work to fix it and to get you the information you needed another way in the meantime.
